Utah law requires drivers involved in an accident to stop, remain at the scene, and provide certain information. Failing to do so is commonly referred to as a “hit and run” and can lead to misdemeanor or felony charges depending on the circumstances.
Accidents Involving Property Damage
Under Utah Code ยง 41-6a-401, a driver who knows or has reason to believe they were involved in an accident resulting only in property damage must stop and remain at the scene until they have fulfilled all of their legal obligations including:
- Providing their name, address, and vehicle registration informatio
- Providing insurance information
- Showing a driver’s license upon request
- Notifying law enforcement if the property damage appears to exceed $2,500
If the damaged vehicle or property is unattended, the driver should locate the owner or leave a written note containing the required information.
A driver who fails to comply with these requirements may be charged with a Class B misdemeanor.
Accidents Involving Injury
When an accident results in injury to another person, Utah law imposes more serious obligations and consequences. Utah Code ยง 41-6a-401.3 also mandates a driver who has reason to believe they were involved in an injury accident must immediately stop and remain at the scene. However, leaving the scene of an accident involving injury is generally a Class A misdemeanor. Further, an accident involving more serious bodily injury may be charged as a third-degree felony.
Accidents Involving Death
Under Utah Code ยง 41-6a-401.5, a driver who leaves the scene of an accident involving a fatality may be charged with a third-degree felony.
Potential Consequences
Hit and run charges can carry significant penalties such as fines, jail time, and impacts on driver’s license status.
In 2026 the Utah Legislature changed the penalties for a hit and run to match the penalties for a DUI. This is because the Legislature believes that most DUIs are because drunk drivers want to avoid being punished for driving under the influence of drugs or alcohol.
