What is Hazing?
Hazing is a common practice at larger colleges and universities around the country, especially those with Greek Life. Historically, hazing has been used to initiate students into sororities, fraternities, and other social clubs. Because this is is such a common issue throughout the college experience, there are many regulations prohibiting the activity.
Legal Definition
Utah Code ยง 76-5-107.5 defines hazing as recklessly, knowingly, or intentionally committing an act that:
- Endangers the physical or mental health of an individual
- Involves violence or brutality in a physical manner
- Involves consuming any substance or participating in a physical activity that endangers the safety of an individual
- Involves any instance where an individual undergoes high levels of mental stress
These are broad descriptions of distressing situations an individual may find themselves in. In order to be considered hazing, these activities must be done for admission or continued participation in an organization.
Consequences of Hazing in Utah
- Class B Misdemeanor โ A base level hazing offense
- Class A Misdemeanor โ The hazing involves a vehicle or alcohol/drugs
- Third-Degree Felony โ The hazing involves a weapon or causes major physical harm
- Second-Degree Felony โ The hazing involves both a weapon and major physical harm
Depending on the level of the charge, punishments may range from fines to jail time. Utah law also allows for concurrent charges to be filed in cases of hazing that may relate to the same event. These often include DUI offenses or assault charges.
Legal Protections
Bystanders can be protected from both criminal and civil action by speaking out against any hazing practices. Utah law protects those who report such behavior to encourage the overall safety of students. However, it is also important to note that consent is not a proper legal defense against hazing. This is because any individual under 21 years of age cannot legally agree to take part in such activities.
Hazing is an important matter that has led to the death of multiple college students over the years. The laws in Utah send a message that social acceptance should not come at the cost of an individualโs sanity, dignity, or life.
