Utah Code ยง53-3-223 (2025) – Reinstatement after DUI Suspension

Important: Early reinstatement is not automatic. The license holder must initiate the petition to reinstate through the Utah Driver License Division (DLD). If no petition is submitted, the license will remain suspended for the full time period.

STARTING THE REINSTATEMENT PROCESS

Step 1: Confirm Eligibility
  • First DUI offense โ†’ suspension is 120 days. No specific waiting period is required.
  • Second or later DUI โ†’ suspension is 2 years, but you can petition after serving at least 90 days of the suspension.
  • Chemical test refusal (first offense) โ†’ revocation is 18 months (or until age 21, whichever is longer), but you may petition after 90 days.
  • Your prior DUI(s) must be misdemeanor-level offenses.
Step 2: Contact the DLD Hearing Officer
  • Call the DLD and ask to petition for early reinstatement.
  • Phone: 801-965-4437 (Salt Lake area) or 888-353-4224 (toll-free).
  • The hearing may be held in person, by phone, or online.
Step 3: Install an Ignition Interlock Device (IID)
  • An approved IID must be installed in every car you own or drive.
  • As of March 12, 2024, all Utah IIDs must include a camera.
  • Provide proof of installation to the hearing officer.
Step 4: Attend Your Hearing
  • Be prepared for the hearing officer to review:
    • Your driving record;
    • Confirmation that your Ignition Interlock Device is installed and registered.
  • The officer will decide whether to approve early reinstatement.
Step 5: Pay All Fees
  • If approved, you must pay reinstatement fees.
  • Fees may be paid:
    • By phone: 801-965-4437 or 888-353-4224.
    • In person (appointment required).
  • Note: Fees are non-refundable, even if your license is suspended again later.

FOLLOWING THROUGH AFTER REINSTATEMENT

Step 6: Comply with IID Requirements
  • If granted early reinstatement, you must keep the IID for the full restriction period:
    • 120 days (first DUI offense).
    • 2 years (second or later DUI).
  • Do not remove the IID early. If you do:
    • Your license will be re-suspended for the rest of the original suspension/revocation period.
    • You will have to pay another reinstatement fee.
    • You cannot petition for early reinstatement again.
    • There may also be additional criminal charges and penalties.
Step 7: Keep All Paperwork in a Safe Location
  • Your IID installation receipt and documentation.
  • DLD hearing notice/decision.
  • Proof of fee payment.

Final Reminders

  • You are responsible for complying with all DLD requirements.
  • Any violation (like driving without an Ignition Interlock Device or removing it early) may result in losing your license again and other penalties.
