What is Open Container?

An open container refers to any bottle, can, or any other repository containing alcohol that has been opened, had its seal broken, or has been partially consumed. It is very common for college students to travel between house parties, bars, and other social events. In order to help avoid unsafe situations, especially those involving vehicles, Utah law outlines restrictions on where alcohol can be opened or possessed.

Understanding these rules is important, as violations can occur even if no one in the vehicle is actively drinking.

Legal Definition

Utah Code § 41-6a-526 defines open container violations. A person may be charged when the following criteria are met:

  • An alcoholic beverage container has been opened, its seal broken, or some of the contents have been consumed
  • The container is located within the passenger compartment of a motor vehicle
  • The vehicle is on a public road, highway, or similar public area

The law also prohibits drinking alcohol while operating a motor vehicle or while riding as a passenger in most standard vehicles. Even if the vehicle is parked or stopped, an open container within reach of the driver or passengers may still violate the law.

The Open Container law focuses on accessibility. Alcohol stored in a trunk or another area that is not accessible to passengers is generally allowed.

Certain exceptions to the code exist, including passengers in:

  • The living quarters of a motorhome or camper
  • Licensed limousines or chartered buses
  • Certain commercial passenger vehicles such as taxis or buses

The penalty for violating Utah’s open container law is a Class C Misdemeanor. Penalties are typically the same regardless of age, but additional consequences may apply for those under the legal drinking age.
