Can You Sleep Drunk in Your Car?

Can You Sleep It Off in Your Car?

Technically, yes. Realistically, it’s very hard to do without risking a DUI, even if you never turn the key.

In Utah, people get arrested for DUI while “sleeping it off” all the time. If you’re in the driver’s seat, that’s a problem. If the engine is running because you’re cold, that’s a problem. If an officer believes you recently drove the car while intoxicated, that’s a problem.

You don’t have to be driving to be arrested for DUI.

How to Sleep It Off Legally

Under Utah law, DUI cases often come down to whether you were in actual physical control of the vehicle. There’s no magic formula that makes you safe, but officers and courts typically look at things like:

  • Were you actually asleep or awake?

  • Were you in the driver’s seat?

  • Was the engine running or the keys accessible?

  • Was the vehicle legally parked?

  • Does it appear you drove to that location while intoxicated?

None of these factors, by themselves, guarantee you won’t be arrested. They’re simply pieces of a larger picture.

Can if Be Done Legally

In theory, yes.

In reality, it requires everything to line up perfectly. You’d need to already be parked legally, not be in the driver’s seat, not need the heater, and not draw police attention before you fall asleep. Even then, you’re relying on an officer’s judgment at 2 a.m.

The safer option is simple: call a cab, use a rideshare, or get a designated driver. It’s cheaper than a DUI and far less stressful than trying to explain why you were “just sleeping” in your car.
