What Is Enticing a Minor in Utah?
Utah’s enticing a minor statute addresses several forms of conduct. In an online case, it can apply to knowingly using electronic communications to solicit or attempt to entice a minor—or someone the person believes is a minor—to engage in sexual activity that violates state criminal law.
The issue is more specific than whether a conversation included sexual language. The prosecution must establish the elements of the charged offense, including the required mental state and the connection to unlawful sexual activity.
You can read the current law in Utah Code Section 76-5-417.
What If the Other Person Was an Undercover Officer?
The absence of an actual minor does not automatically defeat an enticing charge. The statute includes communications involving someone the accused believes is a minor.
An in-person meeting is not necessarily required. Electronic communications themselves can form the basis of an allegation. That makes what was communicated—and what the evidence establishes about the person’s knowledge and intent—important to the defense.
Why the Full Conversation Matters
A few selected messages may not answer every important question. Our attorneys review the available conversation in context and identify records that may need to be requested.
Questions can include:
- What did the profile say when contact began?
- When and how was an age stated?
- What did each person say before and after that statement?
- Are messages, attachments, or parts of the conversation missing?
- Do timestamps and account records support the reported sequence?
- What evidence connects the account and messages to the accused?
- How does the alleged conduct relate to the specific charge?
An adult age listed on a profile is a fact to examine alongside later communications. It should not be considered in isolation.
Reviewing Digital Evidence and the Investigation
Online sting cases can involve screenshots, chat exports, account information, device examinations, and police reports. Our team considers whether the materials provided allow a meaningful review of the allegations.
We look for references to additional records, differences between summaries and underlying communications, and technical questions that may require further investigation. When appropriate, we work with qualified experts.
We also examine the investigative timeline and the methods used to obtain evidence. The goal is to identify factual and legal questions that matter to the particular case.
Understanding the Charges and Potential Consequences
Do not assume every online sting case carries the same charge or potential sentence. Ask your attorney to explain:
- The exact offense and classification listed in the charging documents
- What the prosecution must prove
- The potential sentence and other consequences
- Whether registration requirements could apply
- How any additional charges affect the case
- What options may be available to challenge or resolve the allegations
Our Utah felony-defense attorneys help clients understand those questions before making decisions about their case.

Preparing for a Consultation
You do not need to know which legal questions to ask before contacting us. Bring any charging documents, court notices, release conditions, and upcoming hearing dates.
A basic timeline can help us understand what happened. Tell us which accounts, devices, or communications may be involved, and ask how relevant materials should be preserved and shared. Do not delete or alter potentially relevant records.
Let our team know which phone number or email address to use and whether leaving a voicemail is appropriate.
